The arbitration shall take place in Kunming, Yunnan Province, China, and shall be conducted in English. The arbitral award shall be final and binding on both parties.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm, including the infringement of intellectual property rights. All claims must be brought in the parties individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
